Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and BulkUp AI ("BulkUp AI", "we", "us", or "our") governing your use of the BulkUp AI mobile application and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
BulkUp AI is a general wellness and nutrition-tracking tool, not a medical service. Its calorie targets, macro goals, and AI nutrition estimates are informational and approximate. It does not provide medical, nutritional, or healthcare advice and is not a substitute for a doctor, dietitian, or other qualified professional. Consult a professional before changing your diet, especially if you are pregnant, have an eating disorder, or have a medical condition.

1. Eligibility
You must be at least 16 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or guardian who agrees to these Terms. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.
2. The Service
BulkUp AI helps you set a personalized nutrition plan and track calories, protein, weight, water, and consistency toward a weight-gain goal. Features include AI-assisted meal scanning, manual and search-based food logging, a curated food-inspiration library, progress tracking, streaks, and reminders. We may add, change, or remove features at any time.
3. Not medical or professional advice
The Service provides general informational content and estimates only. It does not diagnose, treat, cure, or prevent any disease or condition, and it is not a substitute for professional medical or dietary advice. Calorie and macro recommendations are generated from standard formulas and the information you provide; AI nutrition estimates are approximate. You are solely responsible for decisions you make about your diet and health. If you experience any adverse effects, stop using the Service and consult a healthcare professional. Always seek the advice of a qualified provider with any questions about a medical condition.
4. Accounts
You create an account through our authentication provider using Apple, Google, or email. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from within the app (Profile → Delete account).
5. Subscriptions, free trial & billing
BulkUp AI is offered as an auto-renewing subscription with an optional free trial. Subscriptions and trials are sold and processed by Apple or Google through their app stores; we do not process payments directly.
- Free trial: If you start a free trial, you will not be charged during the trial period. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically begin and your payment method will be charged.
- Auto-renewal: Subscriptions automatically renew at the then-current price for the same period (e.g., monthly or yearly) unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing & cancelling: You can manage or cancel your subscription in your Apple App Store or Google Play account settings. Deleting the app or your BulkUp AI account does not cancel your subscription.
- Pricing: Prices are shown in the app before you purchase and may vary by region and over time. We may change prices for future billing periods with notice as required by the app stores.
- Refunds: Purchases are handled by Apple or Google, and any refunds are governed by their respective policies. We generally cannot grant refunds directly; please contact the relevant app store.
Access to the app's features requires an active trial or paid subscription. If your subscription expires, your access may be limited until you resubscribe.
6. AI features
The AI meal scanner sends the photo you capture to a third-party AI provider to estimate nutrition. AI output is provided "as is", is approximate, and may be incomplete or incorrect. You should review and edit any AI-generated estimate before relying on it, and you remain responsible for the accuracy of the entries you save. You agree not to submit content through the AI features that you do not have the right to submit or that violates these Terms.
7. Your content
You retain ownership of the content you submit, including meal photos, weight logs, notes, and other entries ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, process, and display Your Content solely to operate and provide the Service to you (including sending photos to our AI provider for analysis). You are responsible for Your Content and represent that you have the rights necessary to submit it.
8. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or abusive purpose.
- Reverse-engineer, decompile, scrape, or attempt to access the Service's source code or underlying systems except as permitted by law.
- Interfere with, disrupt, or place undue load on the Service, or attempt to bypass usage limits, security, or the subscription paywall.
- Upload malicious code, infringe others' rights, or submit content that is illegal, harmful, or violates anyone's privacy.
- Use the Service to build a competing product or resell access without our permission.
9. Intellectual property
The Service, including its software, design, text, graphics, and trademarks (excluding Your Content), is owned by BulkUp AI and its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.
10. Third-party services
The Service relies on third-party providers (including Apple, Google, Clerk, Convex, RevenueCat, OpenAI, and Expo). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services or content, and their availability is outside our control.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CALORIE, MACRO, OR AI ESTIMATE IS ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULKUP AI AND ITS DEVELOPERS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR ANY PERSONAL INJURY OR HEALTH OUTCOME, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold harmless BulkUp AI and its developers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, but sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
16. Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which the BulkUp AI developer is established, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.
17. Apple App Store additional terms
If you download the app from the Apple App Store, the following applies and, in case of conflict with the rest of these Terms regarding Apple, controls:
- These Terms are between you and BulkUp AI only, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims relating to the app, including product-liability, regulatory, or intellectual-property claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
